Terms of Service – KaneNabi

This English version is provided for convenience. For users in Thailand, the Thai version shall prevail in accordance with the Personal Data Protection Act (PDPA).
1. Acceptance of Terms
By accessing or using KaneNabi (the "App" or "Service"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree, you must discontinue use of the Service.
2. About Us
KaneNabi is operated by Pongsasit Thongpramoon ("we", "us", "our"), an independent developer based in Thailand.

3. Educational Purpose Only (No Financial Advice)
KaneNabi is an AI-powered behavioral and educational tool designed to help users improve financial habits and decision-making.
KaneNabi does not provide financial, investment, tax, insurance, or legal advice.
The in-app AI assistants, including:
- Jovy (น้องโจวี่)
- Treasurer Judy (เหรัญญิกจูดี้)
provide general informational guidance based on user-provided data.
You must not rely on the Service for:
- Investment decisions (stocks, funds, crypto, derivatives)
- Tax advice
- Insurance or lending decisions
- Any regulated financial service
For professional advice, consult a licensed financial advisor (e.g., CFP® or a professional registered with the Securities and Exchange Commission of Thailand).
We are not responsible for any financial decisions or losses resulting from use of the Service.
4. Eligibility and Account
- You must be at least 10 years old to use the Service
- If you are under 20 years old, you must have permission from a parent or legal guardian
- You must register using a valid Google account
- You are responsible for maintaining account security
You agree:
- Not to share your account
- To provide accurate information
- To use the Service lawfully
We may suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree NOT to:
- Use the Service for illegal activities
- Reverse-engineer or exploit the App beyond what is legally permitted
- Attempt to bypass security systems or protections
- Use bots, scrapers, or automation without permission
- Upload unlawful or harmful content
- Attempt to manipulate or misuse AI assistants beyond their intended purpose
6. User Data and Privacy
You retain ownership of your personal data.
We process your data only to operate and improve the Service.

You may:
- Delete your account at any time within the App (Profile → Settings → Delete account)
- Request deletion via email: pongsasit.thongpramoon@gmail.com

7. Fees, Subscriptions, and Payments
The core features of KaneNabi are free to use.
7.1 Jovy Plus subscription
KaneNabi offers an optional auto-renewing subscription, Jovy Plus, which unlocks an increased daily allowance for the Jovy AI coach and related premium features.
- Price: 99 THB per month (or the local-currency equivalent shown at the point of purchase)
- Billing period: Monthly, charged to your Apple App Store or Google Play account at confirmation of purchase
- Auto-renewal: The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
- Managing or cancelling: You can manage or cancel your subscription at any time in your App Store account settings (iOS) or Google Play subscriptions (Android). Deleting the app does not cancel a subscription.
- Price changes: If we change the price, we will notify you in advance, and any increase will only take effect after you have been given the opportunity to review and accept it as required by the applicable app store.
7.2 Payment processing and refunds
All payments are processed by Apple (App Store) or Google (Google Play), subject to their respective terms. We do not collect or store your card or payment-instrument details. Refunds are handled in accordance with the policies of the App Store or Google Play; please contact the relevant store for refund requests.
8. Intellectual Property
All rights to KaneNabi—including software, design, branding, and content—are owned by Pongsasit Thongpramoon.
You may use the Service for personal, non-commercial purposes only.
You retain ownership of content you create.
By using the Service, you grant us a non-exclusive license to process your content solely to provide the Service.
9. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted availability.
The Service may be unavailable due to maintenance, infrastructure limitations, or external factors beyond our control.
We are not liable for service interruptions.
10. AI System Limitations
KaneNabi includes AI-powered features.
You acknowledge that:
- AI outputs may be inaccurate or incomplete
- Responses may be outdated or incorrect
- The Service should not be relied on for critical decisions
You are responsible for verifying important information independently.
11. Third-Party Services
The Service may integrate with third-party providers, including:
- Google Sign-In (authentication)
- NVIDIA NIM (AI model inference)
- Cloudflare (security and network performance)
- OneSignal (push notifications)
- RevenueCat, Apple, and Google (subscription processing)
- Sentry (crash and error diagnostics)
Your use of these services is governed by their respective terms.
11.1 Apple App Store and Google Play
If you download KaneNabi from the Apple App Store or Google Play, you also agree to the applicable store terms. In addition, where you obtain the App from the Apple App Store, you acknowledge that:
- These Terms are concluded between you and Pongsasit Thongpramoon only, and not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer-protection or privacy law.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Termination
You may stop using the Service at any time.
We may suspend or terminate access if:
- You violate these Terms
- Required by law
- Necessary to protect users or the Service
After termination, your data will be handled according to our retention policies.
13. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, to the fullest extent permitted by law.
14. Limitation of Liability
To the maximum extent permitted under Thai law:
Our total liability is limited to:
- The amount you paid in the past 12 months, OR
- 1,000 THB
whichever is greater.
15. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand.
Disputes shall be subject to the courts of Bangkok, Thailand.
16. Changes to Terms
We may update these Terms from time to time.
Material changes will be notified in advance (e.g., in-app notice at least 14 days before effective date).
Continued use of the Service constitutes acceptance of the updated Terms.
